Overview
Mikaela Witherspoon guides clients through U.S. and international privacy laws, ensuring compliance with data regulations in their commercial agreements, consumer requests, and data transfers. She provides strategic guidance on privacy obligations, helping businesses develop policies and frameworks that align with evolving regulations and industry best practices.
She advises a range of clients, including middle-market and smaller data brokers, as well as B2B tech, software, and database companies with international footprints, helping them navigate global privacy regulations and manage risk as they expand into new markets. She also works with clients across various industries to develop effective data privacy compliance strategies tailored to their needs.
Mikaela counsels on comprehensive privacy regulations, including the California Consumer Privacy Act (CCPA) and its amendment, the California Privacy Rights Act (CPRA), Nebraska Data Privacy Act, Colorado Privacy Act (CPA), Utah Consumer Privacy Act (UCPA), and Virginia Consumer Data Protection Act (VCDPA), as well as certification to and compliance with the EU-U.S. Data Privacy Framework. She also develops policies and procedures to ensure clients are in compliance with the European General Data Protection Regulation (GDPR).
She also advises on privacy-compliant policies and data protection strategies, helping clients mitigate regulatory risk while safeguarding sensitive data and intellectual property. Her experience includes drafting and reviewing privacy policies, website terms of use, and data processing addendums.
Mikaela is a member of the International Association of Privacy Professionals and holds the ANSI-accredited Certified Information Privacy Professional/Europe (CIPP/E) credential through the organization.
