Peter will provide an overview of how traditional employee benefits were impacted as a result of the Covid-19 Pandemic and the emergence of unique employee benefits as a result of the Pandemic. Additionally, we will review new legislation that was enacted as a result of the Pandemic and current proposed legislation affecting employee benefit plans.

David and Jack will present on the importance of carefully reviewing and drafting boilerplate provisions, while highlighting 5 potentially problematic provisions that create material issues for parties if not given the proper attention.

Directors and officers often become the target for blame (and, thus, claims) when a company is close to, or in the zone of, insolvency. This CLE will review the fiduciary duties of loyalty and due care owed by directors and officers, discuss when creditors may enforce those duties, analyze the impact of bankruptcy or insolvency on existing D&O insurance coverage, and provide practice guidance to directors and officers to shield themselves from liability. 

In this presentation Erin will cover five major legal updates to be aware of when managing a workforce in 2022, including: the DOL’s proposed change to the overtime rule, the OFCCP Contractor Reporting Portal, new state and local pay transparency laws, new statutory restrictions on non-compete agreements, and what’s new in workplace health and safety.

Kristin will cover recurring ethics issues for in-house counsel, including protecting attorney-client privilege, particularly during internal investigations; identifying the client; and representation of a company’s subsidiaries or other affiliates.

Navigating the new world of vaccinations, masks, and other COVID-19 related protocols can be tricky for employers. Jackie will walk employers through the key considerations from a legal and practical perspective when dealing with mandatory mask and vaccination mandates in the workplace to help ensure employers do not fall victim to common legal pitfalls.
